– Rig Routes Website and Mobile Application Terms of Use
– The Rig Routes website (the “Site”) and mobile application (the “App”) are online services provided by Rig Routes, LLC (“Rig Routes”), subject to your compliance with the terms and conditions set forth below. PLEASE READ THIS DOCUMENT CAREFULLY BEFORE ACCESSING OR USING THE SITE OR APP. BY ACCESSING OR USING THE SITE OR APP, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH BELOW. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE SITE OR APP. RIG ROUTES MAY MODIFY THIS AGREEMENT AT ANY TIME, AND SUCH MODIFICATIONS SHALL BE EFFECTIVE IMMEDIATELY UPON POSTING OF THE MODIFIED AGREEMENT ON THE SITE OR APP. YOU AGREE TO REVIEW THE AGREEMENT PERIODICALLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED ACCESS OR USE OF THE SITE OR APP SHALL BE DEEMED YOUR CONCLUSIVE ACCEPTANCE OF THE MODIFIED AGREEMENT.

– Use of Service
– The Service is provided solely for the purpose of assisting users in obtaining information about rig transportation routes and hazards. You agree not to use the Service for any unlawful purposes or in any manner that may impair the performance, integrity, or security of the Service.
– Additional Statement for Use of Service:
– Purchasers and users of the Rig Routes platform acknowledge that the mapping service provided is intended for informational purposes only and should not be relied upon as the sole basis for decision-making in critical situations. Companies utilizing the services of Route Assessors are responsible for conducting their own due diligence and risk assessments to ensure the safety and efficiency of their operations. Rig Routes encourages purchasers and users to supplement route information with additional sources and expert consultation as deemed necessary.
– Route Assessor Verification
– Purchasers and Users of the Rig Routes platform are strongly encouraged to verify that Route Assessors appointed by their respective companies are adequately trained and qualified to understand and identify road hazards. While Rig Routes provides a mapping service to assist in route assessment, the responsibility for ensuring the competency of Route Assessors lies solely with the purchasing company. Rig Routes disclaims any liability for errors, omissions, or inaccuracies in route assessments conducted by Route Assessors, and strongly advises purchasers and users to prioritize the training and qualification of their appointed assessors to mitigate potential risks associated with rig transportation.
– It is incumbent upon you to diligently verify that your Route Assessors are thoroughly trained and proficient in adhering to your company’s policies and procedures. The safety of your workforce hinges not solely on the utilization of Rig Routes, but rather on the adeptness of your assessors in accurately identifying and documenting various road hazards. While Rig Routes facilitates route assessment through its mapping service, the onus of ensuring the competence of Route Assessors rests entirely with the purchasing company. Rig Routes absolves itself of any liability pertaining to errors, omissions, or inaccuracies in route assessments conducted by Route Assessors, and strongly advocates that purchasers and users prioritize the comprehensive training and qualification of their appointed assessors to mitigate potential risks associated with rig transportation.
– Rig Routes does not authorize or conduct route assessments; rather, it provides a software and mobile app tool for recording measurements along potential routes. Users are responsible for ensuring that route assessments are conducted by qualified personnel in accordance with all applicable laws and regulations.
– It is imperative that Purchasers and their Users seek legal counsel to ensure compliance with all state and local laws governing road and route assessment, as well as permitting requirements, particularly concerning load-bearing bridges, height and weight measurements. Failure to adhere to these laws could result in significant legal consequences, including fines, penalties, and potential liabilities. Therefore, it is strongly advised that Purchasers and Users consult with legal experts to navigate the complex regulatory landscape and mitigate any potential risks associated with rig transportation.
– Examples of potential hazards training:
– Powerlines, Low clearances, Steep grades, Narrow bridges, Sharp curves, Soft shoulders, Limited visibility, Unmarked intersections, Loose gravel, Road construction, Poor signage, Railroad crossings, Wildlife crossings, Flooding, Ice patches, Mudslides, Sinkholes, Overhead obstructions, Debris on the road, Poor road conditions and more.
– User Accounts
– In order to access certain features of the Service, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Rig Routes reserves the right to suspend or terminate your account at any time for any reason.
– User accounts on the Rig Routes platform are established to facilitate secure access and usage of our services. Each user account is associated with a unique set of credentials and permissions, which are determined based on the user’s role and responsibilities within the organization. User roles may include administrators, route assessors, operators, and other personnel involved in the new rig pad or rig relocation process. Users are required to create accounts using accurate and up-to-date information and to maintain the confidentiality of their login credentials. Rig Routes reserves the right to monitor user account activity for security purposes and may take appropriate action in cases of suspected unauthorized access or misuse. By creating a user account and accessing our platform, users agree to comply with our terms and conditions and to use their accounts solely for authorized purposes related to rig relocation and route assessment. Users are strongly advised to regularly update their account passwords and to refrain from sharing their login credentials with any unauthorized third parties. Rig Routes bears no responsibility for any unauthorized access or misuse of user accounts resulting from the user’s failure to adhere to security protocols or to maintain the confidentiality of their login credentials.
– Intellectual Property
– All content, materials, and features available through the Service, including but not limited to text, graphics, logos, images, and software, are the property of Rig Routes or its licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or otherwise use any content from the Service without the express written consent of Rig Routes.
– The Rig Routes Web Application and Mobile Application, including all content, features, and functionality, are the exclusive property of Rig Routes, LLC and are protected by copyright, trademark, and other laws relating to intellectual property rights. Users are granted a limited, non-exclusive, non-transferable license to access and use the Rig Routes Web Application and Mobile Application solely for their internal business purposes as permitted by these Terms and Conditions. Any unauthorized use, reproduction, distribution, or modification of the Rig Routes Web Application or Mobile Application, or any portion thereof, is strictly prohibited and may result in legal action. Users may not reverse engineer, decompile, or disassemble the Rig Routes Web Application or Mobile Application, nor may they create derivative works based on the Rig Routes Web Application or Mobile Application without the express written consent of Rig Routes, LLC.
– Use of the Rig Routes Web Application and Mobile Application does not confer any rights to sell or profit from the services provided by Rig Routes. The use of Rig Routes is intended solely for internal business purposes and is not authorized for resale or commercial exploitation without the express written consent of Rig Routes, LLC. Any unauthorized use of Rig Routes for profit or commercial gain is strictly prohibited and may result in legal action.

– Rig Routes provides a mapping service through its web application and mobile app, allowing companies to create routes with the assistance of designated Route Assessors. However, Rig Routes does not have any involvement in the selection or training of Route Assessors. Therefore, Rig Routes cannot be held liable for any routes created by Route Assessors chosen by the respective companies. By using the Rig Routes platform, users acknowledge and accept that Rig Routes bears no responsibility or liability for the accuracy, completeness, or safety of the routes created by Route Assessors. Users agree to hold Rig Routes harmless from any claims, damages, or losses arising from the use of routes generated through the Rig Routes platform.
– Indemnification
– You agree to indemnify, defend, and hold Rig Routes, its officers, directors, employees, agents, and affiliates harmless from any and all claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, any violation of these Terms and Conditions, or any third-party claims arising from your actions or omissions. This indemnification obligation shall survive the termination of your use of the Service.
– Governing Law and Jurisdiction
– These terms and conditions shall be governed by and construed in accordance with the laws of Lucas County, Ohio, without regard to its conflict of laws principles. By agreeing to these terms, you consent to the exclusive jurisdiction and venue of the courts located in Lucas County, Ohio, for the resolution of any disputes arising out of or related to these terms and conditions. Any legal action or proceeding against Rig Routes or its affiliates must be filed in Lucas County, Ohio, and you hereby waive any objection to such jurisdiction or venue.
